By placing an order with Ninongs Lechon, you (the “Customer”) agrees to be bound by this Order Policy, together with our Terms & Conditions, Privacy Policy, and any other policies referenced herein (collectively, the “Agreement”). This policy applies to all catering orders, including but not limited to lechon, sides, and full event catering services.

1. Order Placement & Acceptance

All orders must be placed via our website, email, or phone. We reserve the right to refuse, modify, or cancel any order for any reason, including but not limited to:

• Unavailability of ingredients or staff
• Scheduling conflicts
• Errors in pricing or menu descriptions
• Suspected fraud or violation of laws/regulations
• Your failure to comply with these terms

An order inquiry (via email or other means) does not constitute acceptance. A binding contract is formed only when we confirm the order in writing and receive the required down payment. Minimum order requirements may apply based on event size, location, and menu selections (e.g., minimum guest count for full catering setups).

2. Order Cutoff Times

• For weekend orders (Friday through Sunday), orders must be placed on or before the Tuesday preceding the weekend to ensure standard processing and availability.
• Orders placed after Tuesday may be accommodated at our sole discretion, subject to schedule availability and a rush order charge (typically 20-50% of the total order value, depending on complexity and timing). We will notify you of any such charges before proceeding.

3. Pricing & Menu Selections

• All prices are quoted in USD and are exclusive of taxes, delivery fees, setup charges, gratuities, or other applicable fees unless expressly stated.
• Menu items and pricing are subject to change without notice due to market fluctuations, seasonal availability, or supplier costs. We will notify you of any changes affecting your order.
• Custom menu requests (e.g., dietary modifications, special preparations) must be submitted at the time of ordering and may incur additional fees.

4. Payments & Down Payments

• A down payment of no more than 50% of the total estimated order balance is required to secure your order and reserve your date/time slot.
• The down payment is non-refundable and will be applied toward the final balance.
• Full payment of the remaining balance is due upon delivery. For Wedding/Events we require payment the day before. We accept credit cards, Zelle, or cash].
• Overdue payments may result in order cancellation, forfeiture of the down payment, and additional late fees (e.g., 1.5% per month on outstanding balances).
• You are responsible for any applicable sales taxes, service charges, or import/export fees.

5. Cancellations

• Orders may be canceled by providing written notice (via email to webmaster@ninongslechon.com) as well as phone confirmation. However, the down payment will be forfeited in full upon cancellation.
• Cancellations made less than 5 days before the scheduled order date may also incur additional charges for any incurred costs (e.g., ingredients purchased, staff scheduling).
• In the event of cancellation by us (e.g., due to unforeseen circumstances), we will provide a full refund, including the down payment, within 10 business days.

6. Rescheduling & Changes

• We recommend rescheduling instead of cancellation to avoid forfeiting your down payment. Rescheduling requests must be done over the phone at least 5 days before the original scheduled order date.
• Rescheduling is subject to our sole discretion, handled on a case-by-case basis, and dependent on schedule availability. New dates and times will be offered based on our calendar, and additional fees may apply (e.g., for rush adjustments or increased costs).
• Changes to the order (e.g., menu, guest count, delivery details) must be requested at least [7-14] days in advance and may incur fees or require an adjusted down payment. Last-minute changes (within 5 days) are not guaranteed and may be subject to rush charges.

7. Delivery, Setup & Pickup

• Delivery times are estimates only and not guaranteed. We aim to deliver within a 30-60 minute window of the requested time.
• You must provide accurate delivery instructions, including access details (e.g., parking, elevators). Additional fees may apply for remote locations, after-hours deliveries, or complex setups.
• For self-pickup orders, items must be collected during specified hours, there is a 15 minute grace period; failure to do so may result in additional fees.
• We are not liable for delays due to traffic, weather, or other external factors. Risk of loss or damage passes to you upon delivery or pickup.

8. Food Safety, Allergies & Dietary Restrictions

• All food is prepared in facilities that may handle common allergens (e.g., nuts, dairy, gluten, shellfish). We cannot guarantee allergen-free environments.
• You are responsible for informing us of any allergies or dietary needs at the time of ordering. We will make reasonable accommodations but disclaim liability for allergic reactions or related issues.
• Perishable items must be consumed or refrigerated promptly after delivery. We are not responsible for food safety after delivery/pickup.

9. Returns & Refunds

• Due to the perishable and custom nature of our products (e.g., freshly prepared lechon), all sales are final. No returns, exchanges, or refunds except in cases of proven defect (e.g., incorrect order) or our error.
• Report any issues (with photos) within [2-4] hours of delivery/pickup for investigation. Approved refunds will be issued to the original payment method within [7-10] business days, minus any non-refundable portions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO ANY ORDER SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THAT SPECIFIC ORDER.

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, PERSONAL INJURY (EXCEPT WHERE CAUSED BY OUR GROSS NEGLIGENCE), OR PROPERTY DAMAGE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Force Majeure

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government restrictions, supply shortages, strikes, or transportation disruptions.

12. Governing Law & Dispute Resolution

This Order Policy shall be governed by the laws of the [State/Province/Country, e.g., Philippines or your jurisdiction], without regard to conflict of law principles. Any disputes arising out of or relating to any order shall be resolved exclusively through [e.g., arbitration or courts in your location].

13. Entire Agreement & Updates
